REFUND & RETURNS POLICY

FINALITY OF SALE – LIMITATION OF LIABILITY – COLLECTOR TRANSACTIONS


1. Finality of Sale

1.1 All items offered by Autographs & Militaria are historical collectibles and are sold strictly on an “as is” and “as available” basis.

1.2 Due to the unique, rare, and historical nature of the items, all sales are considered final.

1.3 Returns, cancellations, exchanges, chargebacks, or refunds are not accepted unless expressly agreed in writing by the Seller prior to or at the time of sale.

1.4 No return shall be accepted after delivery unless the Seller has provided prior written authorization.

1.5 The Buyer acknowledges that historical collectibles differ from standard consumer goods and that once ownership has transferred, reversal of the transaction is not an automatic right.

1.6 Completion of payment constitutes full acceptance of these terms and confirmation that the Buyer has made an informed purchasing decision.


2. No Refund Grounds

2.1 No refund, return, or compensation shall be granted on the basis of:

• Change of mind
• Buyer’s remorse
• Financial reconsideration
• Market value fluctuation
• Future resale performance
• Auction results
• Investment expectations
• Differences in subjective opinion
• Subsequent third-party authentication review
• Subsequent expert disagreement
• Scholarly re-evaluation
• Attribution debate
• Change in academic interpretation

2.2 The Buyer expressly acknowledges that the market for historical collectibles is volatile and subject to evolving academic and expert interpretation.

2.3 The Seller does not guarantee future valuation, resale success, or investment performance of any item.


3. Intermediary and Provenance Disclaimer

3.1 The Seller operates as an independent dealer and intermediary of historical collectibles.

3.2 Items may have been previously acquired from:

• Auction houses
• Private collectors
• Estates
• Dealers
• Third-party sellers

3.3 At the time of acquisition, such items were represented as legitimate and authentic by their respective source.

3.4 The Seller relies in good faith on documentation, provenance, descriptions, and certifications provided by those sources.

3.5 To the fullest extent permitted by law, the Seller shall not be held responsible for:

• Misrepresentations made by previous owners
• Errors in prior auction catalogs
• Inaccuracies in third-party descriptions
• Certificates issued by third parties
• Attribution errors originating before acquisition
• Undisclosed restoration performed prior to acquisition
• Historical inaccuracies contained in previous documentation

3.6 Authentication of historical autographs and documents involves expert interpretation and is not an exact science. Opinions may evolve over time.

3.7 No lifetime authenticity guarantee is provided unless expressly stated in writing and signed by the Seller.


4. Condition and Description Acknowledgment

4.1 All items are historical artifacts and may exhibit:

• Natural aging
• Paper fragility
• Fading ink
• Oxidation
• Handling marks
• Storage marks
• Minor tears
• Stains
• Surface irregularities

4.2 Such characteristics are inherent to period materials and do not constitute defects.

4.3 The Buyer acknowledges that they have:

• Carefully reviewed all photographs
• Read the item description
• Requested clarification where necessary
• Accepted the condition as presented

4.4 The Seller shall not be responsible for dissatisfaction arising from characteristics visible in photographs or reasonably expected in historical materials.


5. Risk Allocation and Buyer Responsibility

5.1 The Buyer bears full responsibility for conducting their own due diligence prior to purchase.

5.2 The Buyer acknowledges that they are purchasing the item for collecting, historical, or academic purposes.

5.3 The Buyer assumes all risks inherent to historical collecting, including but not limited to future re-attribution, market volatility, and expert disagreement.


6. Chargebacks and Payment Disputes

6.1 Initiating a payment dispute or chargeback without prior written communication with the Seller constitutes breach of these Terms.

6.2 The Seller reserves the right to contest any unjustified chargeback and to provide documentation of these Terms as evidence of final sale agreement.


7. Limitation of Liability

7.1 To the maximum extent permitted by applicable law, the Seller shall not be liable for:

• Indirect damages
• Consequential damages
• Incidental damages
• Loss of profits
• Loss of opportunity
• Loss of investment value
• Emotional distress
• Reputational damage

7.2 In the event liability is legally established, total liability shall not exceed the purchase price paid for the item.


8. Legal Compliance

8.1 Nothing in this policy excludes or limits liability where such limitation would be unlawful under applicable law.

8.2 Where mandatory consumer protection laws apply, such rights shall prevail to the minimum extent required by law.


9. Acceptance

By completing a purchase, the Buyer confirms that:

• They have read and understood this Refund & Returns Policy
• They accept that the sale is final
• They agree to the limitation of liability provisions
• They assume the inherent risks of historical collecting
